These Terms of Service (“Terms”) govern your access to and use of hypertxt.ai (the “Site”) and the launch waitlist, operated by Packstack, LLC (“Hypertxt,” “we,” “us,” or “our”). By using the Site or joining the waitlist, you agree to these Terms. If you do not agree, do not use the Site.
1. The Service
Hypertxt is an AI-powered content creation platform that is currently in pre-launch. The Site presently provides information about the product and the ability to join a waitlist. Features described on the Site are subject to change and may differ at launch.
2. The Waitlist
Joining the waitlist lets us notify you about availability and updates. It does not create any obligation for us to launch the product, to provide access by any particular date, or to offer any specific pricing or feature. We may contact you by email about the launch; you can unsubscribe at any time.
3. Eligibility
You must be at least 16 years old (or the age of digital consent in your jurisdiction) and able to form a binding contract to use the Site or join the waitlist. You agree to provide accurate information, including a valid email address that you own.
4. Acceptable Use
You agree not to:
- Submit false, misleading, or third-party information without authorization;
- Use the Site to violate any law or infringe the rights of others;
- Attempt to disrupt, overload, probe, or gain unauthorized access to the Site or its systems; or
- Use automated means to submit the waitlist form or scrape the Site without our permission.
5. Intellectual Property
The Site and its content — including text, design, logos, and the “Hypertxt” name and marks — are owned by or licensed to Packstack, LLC and are protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission, except for personal, non-commercial viewing of the Site.
6. Third-Party Links & Services
The Site may reference or link to third-party websites and services that we do not control. We are not responsible for their content, policies, or practices, and your use of them is at your own risk.
7. Disclaimers
The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any launch will occur.
8. Limitation of Liability
To the fullest extent permitted by law, Packstack, LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Site or the waitlist. Our total liability for any claim relating to the Site will not exceed USD $100.
9. Indemnification
You agree to indemnify and hold harmless Packstack, LLC from any claims, losses, or expenses arising out of your misuse of the Site or violation of these Terms.
10. Governing Law
These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-law principles. You agree to the exclusive jurisdiction of the state and federal courts located in Minnesota for any dispute arising from these Terms.
11. Changes to These Terms
We may update these Terms from time to time. We will revise the “Last updated” date above, and your continued use of the Site after changes are published constitutes acceptance of the updated Terms.
